1. Agreement to Terms

By accessing and using Watomate, you agree to be bound by these Terms of Service. If you do not agree, do not use our platform.

2. Service Description

Watomate is a WhatsApp automation platform for Shopify merchants that enables:

  • Automated cart recovery messaging
  • Order confirmation and shipping notifications
  • Bulk promotional campaigns
  • Customer segmentation and analytics
  • Real-time Shopify store synchronization

3. Eligibility

You represent that you are:

  • At least 18 years of age
  • A Shopify merchant or authorized representative
  • Operating in compliance with local laws
  • Authorized to bind your business to these terms

4. Account Registration & Security

  • You are responsible for maintaining account login credentials
  • You agree to provide accurate, current information
  • You are liable for all activities under your account
  • Notify us immediately of unauthorized access
  • You agree not to share login credentials with unauthorized users

5. Acceptable Use Policy

You agree NOT to:

  • Send spam, unsolicited messages, or abuse WhatsApp platform
  • Violate WhatsApp Business API policies or terms
  • Use our service for illegal activities or scams
  • Harass, threaten, or defame individuals
  • Send messages without customer consent (where required by law)
  • Impersonate other businesses or individuals
  • Attempt to hack, reverse-engineer, or compromise our systems
  • Send messages in violation of Pakistani telecom regulations or GDPR (if applicable)

Violation may result in immediate account suspension.

6. Customer Consent

You represent and warrant that:

  • You have obtained valid consent from customers before sending WhatsApp messages
  • Your messaging complies with WhatsApp Business API policies
  • You comply with all applicable telecom laws (including Pakistan Telecom Authority regulations)
  • You will promptly honor opt-out requests from customers

You are solely responsible for compliance. We are not liable for your messaging practices.

7. Pricing, Credits & Payments

A. Credit System:

  • You purchase message credits manually through our platform
  • Each credit allows you to send one WhatsApp message
  • Credit packages are priced as displayed on our website
  • Credits do not expire (unless specified in your plan)
  • Credits are non-refundable once purchased and added to your account

B. Payment Process:

  • You initiate a payment request for your desired credit package
  • Our team reviews and approves your payment (typically within 24 hours)
  • Accepted payment methods: Bank transfer, Jazz Cash, Easypaisa, or other methods as approved by our team
  • Once payment is verified, credits are instantly added to your account
  • You are responsible for providing accurate payment details

C. Plan Selection:

  • Choose from our available plans (Starter, Growth, Pro, etc.)
  • Each plan includes a specific number of credits per billing cycle
  • Plan details and pricing are available on our website
  • Plans renew monthly/annually based on your selection

D. Failed/Pending Payments:

  • If payment is not verified within 7 days, your credit request may be cancelled
  • Service may be limited if credits fall below a certain threshold
  • Re-submit payment for approval if your request expires

E. Refund Policy:

  • Credits are non-refundable once purchased and added to your account
  • Disputes must be raised within 14 days of purchase
  • Refunds are issued only if our team confirms an error on our part
  • Our team has final discretion on all refund requests

8. Credit Usage & Limits

  • You are responsible for monitoring your credit balance
  • Messages are not sent if insufficient credits are available
  • Usage reports and credit deductions are tracked in your dashboard
  • Our team may suspend service if we detect unusual activity or policy violations

9. Billing & Invoices

  • Invoices are provided via your account dashboard
  • You are responsible for all applicable taxes and duties
  • Keep records of payment receipts for your business records

10. Intellectual Property

  • Watomate retains all rights to our platform, code, designs, and content
  • You retain ownership of your data and customer information
  • You grant us a license to use your data solely to provide our services
  • You may not reproduce, distribute, or resell our service without permission

11. Data & Backups

  • We provide analytics and message history for your convenience
  • We are NOT responsible for data loss due to technical failures, user error, or circumstances beyond our control
  • We recommend you maintain regular backups of important data
  • We reserve the right to delete inactive accounts after 180 days of non-use (with notice)

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Watomate is provided "AS IS" without warranties of any kind
  • We are NOT liable for indirect, incidental, consequential, or punitive damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not liable for third-party services (WhatsApp, Shopify, payment processors)
  • We are not liable for message delivery failures, rejections, or blocks by WhatsApp

13. Disclaimer of Warranties

WE MAKE NO WARRANTY THAT:

  • Our service will be uninterrupted, error-free, or secure
  • Your messages will be delivered or read by customers
  • You will achieve specific business results or ROI
  • Our service complies with all local laws (you are responsible for compliance)

14. Indemnification

You agree to indemnify and hold Watomate harmless from any claims, damages, or costs arising from:

  • Your use of our platform in violation of these terms
  • Your messaging practices or customer complaints
  • Your violation of WhatsApp policies or local laws
  • Your use of data or content

15. Service Availability & Maintenance

  • We strive for high uptime but do not guarantee 100% availability
  • We may perform maintenance, upgrades, or suspend service without liability
  • We may discontinue features or the entire service with 30 days' notice

16. Termination

We may terminate your account immediately if you:

  • Violate these terms or our acceptable use policy
  • Engage in illegal activities or fraud
  • Violate WhatsApp Business API policies
  • Have outstanding unpaid invoices (after 30-day notice)

You may terminate your account anytime, but:

  • Unpaid fees remain due
  • Data deletion takes up to 30 days
  • No refunds for the current billing period

17. Dispute Resolution & Refunds

  • Credit purchase disputes must be reported within 14 days
  • Our team will investigate and determine eligibility for refunds
  • Refunds (if approved) are issued back to the original payment method within 7-10 business days
  • Payment method chargebacks are considered violations of these terms and may result in account suspension
  • Our team's decision on refund eligibility is final
  • Any disputes shall be resolved through arbitration or in Pakistani courts

18. Payment Approval Process

  • We reserve the right to approve or reject payment requests at our discretion
  • We may request additional documentation or business verification
  • Rejection does not obligate us to explain our decision
  • Fraudulent or suspicious payment attempts may result in account suspension or banning

19. Changes to Terms

We may update these terms. Significant changes will be communicated via WhatsApp or email. Continued use constitutes acceptance.
